Privacy Policy
This Privacy Policy (“Privacy”) governs how iHealthOX Technologies Inc. (“iHealthOX”, “iHealthOX”, “us”, “we” or “our”) collects, uses, discloses and otherwise manages your Personal Information, including Personal Health Information (“PHI”) collectively referred to together in this Privacy Policy as “Information” (“information”) and uses a number of safeguards to protect the privacy and the confidentiality of our users. When discussing Healthcare Services, Information typically refers to Personal Health Information (“PHI”), and when discussing Informational Services, Information typically refers to information that is not specifically about you or your health.
This Privacy Policy applies to our privacy practices on (a) iHealthOX (“iHealthOX”, “us”, “we” or “our”) website located at www.ihealthox.com (the “Website”); platform, private portal, content, product and all other services provided by iHealthOX collectively, the “Platform”). For information on the general terms and conditions that apply to individuals (the “Terms of Use”) using the Platform and Services please see our Terms of Conditions.
The iHealthOX Privacy Policy was updated on October 27, 2020. The words and phrases used in this Policy have the same meaning as in iHealthOX Terms of Use. The terms of this Privacy Policy are incorporated into, and considered a part of, the Terms of Use. This Privacy Policy relates to use of the Platform. In the event that any additional or specific terms are inconsistent with the terms contained in this Privacy Policy, such as the terms and conditions prescribed by the Terms of Use, the Terms of Use shall prevail.
Note that this Policy does not apply to the collection, use, retention, disposal, destruction, and protection of Information by Health Providers as they are subject to privacy legislation and professional requirements that govern their management of Information, including Information they collect, use and retain in the course of providing services through the iHealthOX Platform. Please feel free to ask any Health Provider to whom you are referred if you have questions about how he or she will treat your Information.
By accessing the Platform you accept all the terms and conditions of this Privacy Policy. In particular, by submitting your personal data to us, you will be deemed to have given your permission for the use and disclosures referred to herein.
The agreement between iHealthOX and Health Providers Services through the iHealthOX Platform (Provider Agreement) and the Terms of Use for the iHealthOX Platform explain the services that iHealthOX provides to Providers and to Users respectively.
If you do not agree with the terms and conditions of this Privacy Policy, you must immediately cease using and accessing the Platform and any content, services or products contained in or available from the Platform for which you need to provide personal information. Collection and Use of Personal Information
iHealthOX nor its Health Providers collects or uses personal information for any other purpose than providing and facilitating the provision of Services, and purposes consistent with those purposes, including but not limited to the following:
Creating an Account
In order to access the Platform and access the use of Services you (“you”, “your”, “user, “member”) will be required to create a User Account (“Account”) and become a registered user of the iHealthOX Platform. The Services as permitted by the iHealthOX Platform and these Terms are provided to assist you in gathering information about the various services offered by iHealthOX and enable you to use the Platform to access and receive any services offered to you through the Platform, including Mental Health Services offered by a Health Provider, access to a Primary Care Provider, Group Therapy and other Services by text and video for such services, Support Services offered by our one of our Care Coordinators or Technical Support team to receive related administrative support services via online communication tools and products as applicable, facilitate any payments from you to iHealthOX in respect of your use of the Platform or the receipt of any Services through the Platform and to provide feedback and otherwise communicate with iHealthOX in connection with any other products or Services.
By creating an Account, you expressly consent to the use of: (a) electronic means to complete these Terms and to provide you with any notices given pursuant to these Terms; and (b) electronic records to store information related to these Terms or your use of the Services which may include Personal Health Information (“PHI”). iHealthOX cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements. You will also need to disclose your personal information to Health Providers in order to enable them to provide appropriate Services. We use your personal information to identify who you are, communicate with you, and otherwise administer your use of the Platform to receive Services.
Upon registration, you will choose a username and password. You are responsible for keeping that password and username confidential, and for any and all activity that occurs on the Platform under such password or username. You agree to immediately notify iHealthOX of any unauthorized use of your password or username or any other breach of security.
Persons under 16 years old
You must be at least 16 years of age to create an Account, unless you are associated with a Third Party that permits individuals under the age of 16 to create an Account. You are only permitted to request Health or Primary Care Services for you or for Registered Dependents you have added to your Account. You must create a separate “profile” for each Registered Dependent, which will include the person’s name and other personal information. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your User Account username and password at all times. Unless otherwise permitted by iHealthOX in writing, you may only possess one User Account. You will use the Platform in accordance with these Terms, and that all information supplied by you on the Platform is true, accurate, current and complete.
We do not knowingly allow individuals under the age of 16 to create their own User Accounts that allow access to our Services. iHealthOX does not intentionally collect personal data of persons under the age of 16 years old. If we discover that we have collected personal information from a child under the age of 16 years old, we will delete that information immediately. If you register as the parent or legal guardian on behalf of a minor, you are fully responsible for complying with these Terms. The Terms set out above under “Consent to Services, Use and Disclosure of Personal Information” apply to minors who access the Platform and receive Services with necessary changes to points of detail. Minors may only use the Platform and/or receive Services in the presence of their parent or legal guardian.
Purchase of Services
iHealthOX allows you to purchase various types of Membership (“Membership”) access to attain certain specific Programs and Services during a fixed membership term for a flat fee (“Membership Fee”). The Membership Fee is processed through your credit card at the time you initiate your membership. iHealthOX uses a third-party Payment Processor. The processing of payments or credits, as applicable, in connection with your use of the Platform, product and additional services as provided by Service Providers will be subject to the Terms, conditions and privacy policies of the Payment Processor and your credit card issuer in addition to this. Quality of Care
If you access the Platform or receive Services, your personal information may be used to improve the quality of Services provided by Providers. Your personal information may also similarly be used to create de-identified information such as aggregate statistics relating to the use of the Platform and Services.
When you contact us with a comment, question or complaint, you may be asked for information that identifies you (such as your name, address and a telephone number) along with additional information we need to help us promptly answer your question or respond to your comment. We may retain this information to assist you in the future and to improve our customer service, service offerings, and our Services.
Disclosure of Personal Information
Protecting your Information is a top priority for us. We will never disclose, trade, rent, sell or otherwise transfer personal information, without consent, except as otherwise set out herein this Privacy Policy.
By accessing and using the Platform to receive Services and access various products and services you consent your information may be used or disclosed to third parties for one or more of the following service, business or marketing related purposes:
- Be consulted by a iHealthOX Care Coordinator, Support Staff and one or more Health Providers. Health Providers may ask you questions about your personal health history, present condition or symptoms, and any course of treatment or medication that has been prescribed to you. Support Staff only provide Support Services that are informational in nature. You may withdraw your consent to receive Services or Support Services at any time by ending your communication with the Health Provider or iHealthOX Care Coordinator.
- You acknowledge that iHealthOX is only responsible for providing the software required for the transmission of personal information through the Platform and, in light of the foregoing, iHealthOX cannot be responsible for other purposes for which the Platform is used by Health Providers, nor for the privacy practices of Health Providers. You acknowledge and agree that iHealthOX is not responsible for a breach of your personal information if you use the Platform in a public or unsecure environment where a session may be viewed or overheard (e.g. coffee shop) and such personal information is overheard by others in your vicinity.
- iHealthOX disclaims any and all liability related to your interaction with Health Providers that occurs on the Platform or elsewhere.
- Only the Health Providers and iHealthOX Care Coordinators will have access to your personal information and neither iHealthOX nor any other party associated with iHealthOX will disclose your personal information to any third party except as may be required by law or as set forth in our Privacy Policy. Your personal information will be securely and digitally stored on servers physically located in North America. Although iHealthOX uses advanced encryption technology and other security protocols to protect your personal information and the privacy of your online consultations with Health Providers, you acknowledge by using the Platform that there are inherent risks to any technology, however remote, that could cause security protocols to fail or be breached, which could result in the unauthorized collection, use or disclosure of your personal information. iHealthOX will notify you to the extent required by law of any security protocol failure or breach that has resulted in the unauthorized collection, use or disclosure of your personal information. We will not be responsible for any damages you or any third party may suffer as a result of the transmission of confidential information that you make available to us through the Internet, or that you expressly or implicitly authorize us to make, or for any errors or any changes made to any transmitted information.
- There are potential material risks that are specifically associated with using online communication tools and which may adversely impact the ability of the Health Providers, Care Coordinator or Support Staff to provide Services, including but not limited to (a) poor quality audio-video connections due to remote locations or other network limitations that may limit the ability of the Health Provider to appropriately conduct the session or otherwise obtain sufficient personal information from you to properly conduct the session, (b) delays in evaluation or treatment resulting from similar technology failures, (c) lack of access to your personal health records maintained outside the Platform (i.e., by your family physician or other primary care health professional), which may result in judgment errors, and (d) unauthorized collection, use or disclosure of your personal information due to a security protocol breach or failure.
- iHealthOX is not liable for your information stored or recorded by any computer, tablet, mobile device or any network, whether public or private, that you may use to access the iHealthOX Platform.
- In connection with the provision of our Platform and Services, we may disclose (or otherwise make available) personal information to third parties who provide Services on our behalf. For example, we may use service providers to process payments, host our website and store information on our behalf. Personal information may be maintained and processed by third party service providers in North America and may be accessed by the courts, law enforcement and national security authorities as required under the laws of this jurisdiction.
- iHealthOX and our affiliates and service providers may disclose personal information to third parties as required or permitted by applicable provincial, territory and federal laws, including, but not limited to laws related to protecting client and public health and safety. To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations
- Personalize your experience on the website or Platform to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our Websites, third-party sites, and via email or text message (with your consent, where required by law).
- Public Forums: If at any time the Services offer any type of notice board facilities, newsgroups, publicly accessible blogs, community forums, etc. (collectively, the “Public Forums”) we may collect the information that you disclose thereon. We may also use this information in order to help administrate the Public Forums. Such information will be used in accordance with this Privacy Policy. Please note that we cannot be responsible for other parties’ use of the personal information which you make available to such third parties through any of the Public Forums.
Our privacy practices are intended to comply with applicable privacy laws, including, without limitation, the Personal Health Information Protection Act (Ontario) (“PHIPA”) and the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”). We will maintain the privacy of your personal information as required by applicable privacy laws, including without limitation, PHIPA and PIPEDA and the regulations under those Acts.
Access to Personal Information
If you submit personal information via our Platform or otherwise provide us with your personal information, you may request access, an update or correction to your personal information by submitting a written request to support@ihealthox.com. We may request certain personal information for the purposes of verifying your identity.
You may request deletion of your personal information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete personal information, it will be deleted from the active database, including from our archives, though we may also retain Anonymous Information about your use of our Platform and Services. Once we disclose some of your personal information to third parties, we may not be able to access that personal information any longer as maintained by the third party and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.
Cookies and similar technologies
Like many websites, we may use “cookies” and “web beacons” to collect information. A “cookie” is a small data file that is transferred to your computer’s hard disk for record-keeping purposes. A “web beacon” is a tiny image, placed on a Web page or email that can report your visit or use. We may use cookies and web beacons to enable the technical operation of the Platform, to administer your log-in to your account and to collect the Log Data. You can change your browser’s settings so it will stop accepting cookies or to prompt you before accepting a cookie. However, if you do not accept cookies you may not be able to use the Platform. The Platform may also include the use of cookies and web beacons of services owned or provided by third parties that are not covered by our Privacy Policy and we do not have access or control over these cookies and web beacons.
Links and third party websites
The Platform may contain links to other websites, services or offers which are owned, operated and maintained by third parties. We do not have control over third party websites and services and we do not have control over their privacy policies and terms of use. By accessing and using the Platform, the Services and the Content, you expressly release and discharge us from any and all liability arising from your use of any third party website. We strongly encourage you to review the privacy policies applicable to any site you visit.
Changes
Our Privacy Policy may be updated periodically at our sole discretion. Revised changes will be posted on this page and the Platform. If we make any substantial changes to this Privacy Policy we will provide more prominent notice (i.e. email notification). Please check our Privacy Policy on a regular basis.
